It could become an electoral trap for the president (PT) if he vetoes the text, a scenario considered likely if the rapporteur in the Chamber, (PP-SP), resumes the project approved by the deputies, says the Secretary of Public Security.
“This could be an electoral trap. Because today the debate is absolutely contaminated, the population is very far away, in terms of understanding what seems correct to me, we who are scholars, the population is applauding any lethal operation”, says the secretary.
Appointed by former minister Ricardo Lewandowski, he must leave his position under the management of Wellington Lima e Silva.
The risk observed within the Ministry of Justice is that the issue will be used as an electoral weapon to criticize the government’s public security policy, contested by the opposition.
In the Chamber, Derrite, former Secretary of Security of the government (Republicanos-SP), had a series of new criminal types. The rapporteur in the Senate, Alessandro Vieira (MDB-SE), defended the government and also included a tax on bets to finance public security actions.
“Derrite and the Chamber created a third diploma for the legal operator. If this Chamber project remains, it [o advogado] there will be the legal framework for organized crime, the organized crime law, the penal code, the firearms law and the drug law”, says Sarrubbo. “It’s not possible. The Senate corrected it. The Senate text, for us, satisfies. Now, the frustration is that the Chamber tears up everything that was done in the Senate and goes back to the previous text”.
“This will be very bad, in my opinion. Very bad not because of ideology and politics. It will be bad to operate”, he adds.
The secretary assesses that both the project and the PEC (proposed amendment to the Constitution) for Public Security should have been sent to Congress at the beginning of Lula’s term. “It took a long time to go to Congress, in my opinion. There was a problem here in Brazil which was the anticipation of the electoral debate”, he says.
“And there is no greater contamination of ideology and electoral than in public security. Everyone discusses it. Nobody is worried about education, health. It’s public security. And that polarizes the debate”, he highlights.
Sarrubbo states that the PEC was designed to structure the Susp (Single Public Security System), creating an integrated public security policy. However, he says, the idea of coordination was considered an invasion of the states’ competences. “The PEC was, evidently, deconstructed. This report [do deputado Mendonça Filho] causes a setback in the law of the Unified Public Security System”, he criticizes.
“They introduced sentence progression, the age of criminal responsibility, they advanced to something that had nothing to do with the central scope of the PEC. So, obviously, it was very bad, in my view, it is a step backwards in relation to the SUSP”, he says.
