MP cites fraud and says that young man left a friend “to his own devices” in Pico Paraná

The Public Ministry of Paraná denounced Thayane Smithyoung man who abandoned his friend Roberto Faria Thomazin Pico Paraná, for the crime of omission of help. The complaint, published this Thursday (15), mentions that the woman’s conduct is full of intent and that she left the man “to one’s own luck”.

The agency states that Thayane, even after realizing the vulnerable situation in which Roberto found himself, decided to leave his friend behind.

Furthermore, he said that she was aware of the risks of the location and yet “remained without the intention of assisting in the search, showing interest only in her own physical well-beingeven after being warned of the risks of the situation by other mountaineers”.

The MP’s justification is based on the fact that Roberto is physically weakened. He fell ill several times and had great difficulty walking during the journey on Pico Paraná. The danger of the region was also taken into consideration in the demonstration.

After being abandoned, the young man was only found on January 5th. when he managed to reach the base of Pico, on a farm in Antonina Cacatu. He had several bruises and bruises on his body after walking for more than 20 km.

What is “failure to assist?”

Failure to provide assistance is an offense provided for in the Penal Code (Art. 135) and is described as the act of “failing to provide assistance, when possible without personal risk, to an abandoned or lost child, or to a disabled or injured person, when helpless or in serious and imminent danger; or not requesting, in these cases, assistance from the public authority”.

The maximum penalty is six months’ imprisonment.

Compensation of R$13 thousand

For the reasons presented, the MP requests compensation for the moral damages caused to the victim with the projected payment of three minimum wages, which correspond to the total of R$4.863,00, a Roberto.

In addition, the payment of monetary benefits is also proposed – an alternative penalty where the defendant pays a sum of money to the victim or social entities to avoid being arrested – not value of R$8,105.00. The amount would be allocated to the Campina Grande do Sul Fire Department.

The end result compensation is around R$13 thousand.

Provision of services

Furthermore, if the complaint is accepted, Thayane must provide services to the community where he lives for three months, for five hours a week.

The proposed measures are justified, considers the Public Prosecutor’s Office, due to the work carried out in search of the victim, which mobilized, in addition to official forces, several civil agents and volunteers

Now, the complaint must still be accepted or rejected by a Judge, who if approved, will make Thayane defendant in the process and, only then, will he decide whether to proceed with his conviction.
