Bayer reported that it considers the United States Supreme Court’s decision to review the Durnell case, one of the lawsuits linked to the herbicide Roundup, to be positive. According to the company, the judgment on the merits should take place by June 2026, when the next Court session ends.
According to a statement, the case was taken to the Supreme Court following a request filed by Monsanto in April 2025, with the aim of clarifying differences between courts on the application of so-called federal preemption – that is, whether federal rules prevail over state laws on topics such as pesticide labeling.
Bayer claims that a favorable result “would help to significantly contain” the volume of lawsuits involving Roundup, within a “multifaceted strategy” adopted by the company. Bayer acquired the American Monsanto in 2018.

In the text, Bayer CEO Bill Anderson says that “the Supreme Court’s decision to accept the case is good news for US farmers, who need regulatory clarity”. He adds that “it is time for the American legal system to establish that companies should not be punished by state laws when they comply with federal labeling requirements.”
The statement also cites a statement by American Attorney General John Sauer in favor of the Supreme Court’s analysis of the case. He said upholding the Durnell ruling would allow juries to “ignore expert scientific rulings” from the U.S. Environmental Protection Agency (EPA), which has repeatedly concluded that glyphosate “is not likely to be carcinogenic to humans.”
Finally, Bayer states that divergent decisions between federal and state courts reinforce the need for clear guidance from the Supreme Court on the topic.
