INSS CPMI goes to Mendonça against Toffoli’s order and asks for access to Vorcaro’s data

Members of the INSS CPMI will ask Minister André Mendonça, of the Federal Supreme Court (STF), this Monday, the 19th, to return the banking, tax and telematics data of Daniel Vorcaro, owner of Banco Master.

The information was removed from the commission by minister Dias Toffoli, on December 12, who determined that it would not be available to the collegiate. On December 4, CPMI had approved requests to break the banker’s confidentiality.

The commission argues that Banco Master granted more than 250,000 loans with signs of fraud and, therefore, needs the information to further the parliamentary inquiry.

The volume of suspected cases was revealed by Estadão. In a recent statement, the president of the National Social Security Institute (INSS), Gilberto Waller Júnior, confirmed the signs of fraud in Master’s payroll loans.

The INSS CPMI was created to investigate crimes related to illegal associative discounts on pensions and also to payroll loans.

The request presented to André Mendonça is signed by the opposition leadership in the collegiate: Alfredo Gaspar (União-AL), rapporteur; senators Rogério Marinho (PL-RN) and Eduardo Girão (Novo-CE), and deputies Marcel Van Hattem (Novo-RS), Adriana Ventura (Novo-SP) and Luiz Lima (Novo-RJ).

“This emerging data adds to an already robust body of evidence and confirms that the irregularities were not limited to isolated conduct, but involved structured and repeated action by Banco Master within the scope of INSS consigned credit, with possible criminal, administrative and civil consequences”, says the petition.

Parliamentarians argue that, more than 30 days after Toffoli’s decision, there was no definitive decision by the STF on the destination of the requested information. The data is in the administrative custody of the president of the Senate, Davi Alcolumbre (União-AP).

In the group’s assessment, this scenario creates an “unprecedented precedent for blocking legally produced documents” by a CPI.

“There is no serious investigation possible when evidence legally produced by a CPI is removed from its reach and is blocked indefinitely. Minister Toffoli’s decision represents yet another undue interference by the STF in the exercise of the prerogatives of the Legislative Power, emptying the constitutional role of Congress. The immediate return of these documents is essential”, stated Marcel van Hattem, leader of Novo in the Chamber.

The request made to Minister André Mendonça was due to the fact that he was responsible, at the STF, for investigating INSS fraud. Toffoli takes care of the investigation related to signs of fraud at Banco Master.
