Psol sued the Federal Supreme Court this Monday (19) to question the constitutionality of the Rio de Janeiro state law that creates a financial bonus for civil police officers linked to results in operations, including the neutralization of criminals. The party calls for the immediate suspension of the effects of the rule.
The law establishes the payment of premiums ranging from 10% to 150% of the police officer’s salary in cases of seizure of large-caliber or restricted-use weapons and also when suspects are neutralized during police actions.
In the action, Psol maintains that the rule presents unconstitutionality defects by creating financial incentives linked to lethal outcomes. According to the petition, the mechanism can encourage unnecessary arrests, fake confrontations and other conduct that could be classified as abuse of authority. The party claims that public policy “financially rewards death” and reinforces police lethality.

The process was distributed to Minister Alexandre de Moraes, who is already the rapporteur for ADPF 635, known as ADPF das Favelas, which deals with parameters for police operations in communities in Rio de Janeiro.
In the petition, the party states that the State of Rio de Janeiro already faces a scenario of high police lethality and that the bonus creates an internal competition for deaths, favoring extreme conduct. “Life, the axiological core of the constitutional system, cannot be transformed into a remuneration variable”, maintains the party.
The analysis will now be up to the STF, which can analyze the case soon after the return from the judicial recess.
