Gilmar defends the decision to file a request for Toffoli’s removal from the Master case

Minister Gilmar Mendes, of the Federal Supreme Court (STF), defended the decision of the Attorney General’s Office (PGR) to shelve the request to remove Minister Dias Toffoli from reporting on the Master case.

In a publication on his X account this Thursday, the 22nd, the magistrate stated that the resolution highlights the regular functioning of the Republic’s institutions.

Presented by parliamentarians, the representation for suspicion was based on the minister’s trip on a jet with one of the bank’s executive lawyers. The Attorney General of the Republic, Paulo Gonet stated that there was no action to be taken. “The case to which the representation refers is already the subject of investigation before the STF, with regular action by the PGR”, he argued.

“Decisions based on objective legal criteria, removed from circumstantial pressures, strengthen legal certainty and reaffirm the institutional maturity of the Brazilian constitutional system”, wrote Gilmar Mendes in X.

Also according to the minister, in a Democratic State of Law, the preservation of due legal process and respect for institutional guarantees are essential conditions for democratic stability and society’s trust in institutions.

In Gonet’s order, the Attorney General of the Republic did not give an opinion on the merits of the fact discussed in the representation and only mentioned that he had no measures to adopt. The case did not involve the most recent facts revealed about the investment of a brother-in-law of banker Daniel Vorcaro in a resort, which had Toffoli’s brothers as partners.

As Estadão showed, the subject of Toffoli’s possible suspicion is treated with caution at the top of the Attorney General’s Office (PGR). The assessment of members of the body is that it would be difficult for a request of this type to be successful in the STF and that the attempts made at the time of Lava Jato to remove Court ministers from investigations ended up having a “disastrous” result. Based on these assessments, the topic should only become an object of provocation by the PGR if probative elements appear in the files, in addition to the reports already published.
