The governor of Santa Catarina, Jorginho Mello (PL), sanctioned this Thursday (22) a law that prohibits the granting of racial quotas in state universities and higher education institutions that receive public resources from the State. The measure had been approved by the Legislative Assembly of Santa Catarina in December.
In a statement, the Santa Catarina government stated that the sanction considered factors such as “fairer competition in access to universities”, “meritocracy”, respect for the Legislative decision and expanded access for candidates in situations of economic vulnerability.
According to the Executive, the new rule seeks to prioritize socioeconomic criteria in the design of access policies.

The project was authored by state deputy Alex Brasil (PL) and was approved on December 10, with only seven votes against. The text prohibits affirmative policies based on race in institutions covered by the law, but preserves reservations of places based exclusively on income, in addition to those destined for people with disabilities and students graduating from the state public high school network.
The law also provides for sanctions for non-compliance: in addition to the annulment of the result of the selection process, the institution may be fined R$100,000 and have transfers of state public resources suspended.
With the sanction, the rule comes into force and will guide the next selection processes of state universities and institutions that receive funds from the Santa Catarina government.
