The handling of the Master case by Minister Dias Toffoli, of the Federal Supreme Court (STF), led to six representations against the judge in different bodies, such as the Attorney General’s Office (PGR), the National Council of Justice (CNJ) and the Federal Senate.
Since Master’s liquidation in November 2025, Toffoli’s report has been challenged by decisions that are unusual from a legal point of view. The minister also began to be questioned for links with targets of the investigation.
The president of the STF, in the Master case. In a note, Fachin stated that the rapporteur’s conduct is “regular”, and that any challenges to procedural acts will be debated by the court when it returns from recess.
As revealed by the EstadãoToffoli’s family sold its stake in the Tayayá resort to banker Daniel Vorcaro’s brother-in-law, Fabiano Zettel, also investigated for financial fraud. This operation was mediated by a company in the name of Toffoli’s brother, based in a house in Marília, in the interior of São Paulo. Toffoli’s sister-in-law, however, denied that her husband had shares in the resort.
Of the six representations against Toffoli, five are requests for suspicion. While one of these requests has already been denied by the PGR, four others are awaiting an opinion from prosecutor Paulo Gonet. In addition to the arguments to remove the rapporteur of the Master case, Toffoli is the target of an impeachment request filed in the Senate
The first representation against Toffoli was presented to the PGR on December 12 by federal deputies Caroline de Toni (PL-SC), Carlos Jordy (PL-RJ) and Adriana Ventura (Novo-SP). Parliamentarians called for the magistrate to be suspected after the newspaper The Globe reveal that he traveled in the company of lawyer Augusto de Arruda Botelho, who represents a Master director, to watch the Libertadores final in Lima, Peru.
At the time of the trip, Toffoli had not yet taken over reporting on the Master case. However, after being chosen as rapporteur, the minister did not declare himself prevented from considering the case.
The Prosecutor’s Office denied the request for suspicion on the 15th. “The case to which the representation refers is already the subject of investigation before the Federal Supreme Court, with regular action by the Attorney General’s Office. There is, therefore, no action to be taken at the moment”, stated Paulo Gonet’s order. The filing of the representation was praised by STF minister Gilmar Mendes.
After the filing, Caroline de Toni, Adriana Ventura and Carlos Jordy registered a new request for suspicion with the PGR. This time, they based their argument on Toffoli’s family’s connections with the Tayayá resort. According to the petition, the rapporteur has “personal and financial connections” with those investigated in Operation Compliance Zero. The request is being analyzed by the PGR.
In parallel, senator Eduardo Girão (Novo-CE) also informed the PGR of Toffoli’s suspicion of links with Tayayá. The parliamentarian made an addition to the representation this Friday, the 23rd. The request has not yet been assessed by the Prosecutor’s Office.
Like Girão, federal deputy Ubiratan Sanderson (PL-RS) sent a request to the PGR to suspect Toffoli due to the rapporteur’s alleged links with the luxury resort. The Gaucho parliamentarian also officiated at the CNJ for possible violation of the Organic Law of the Judiciary (Loman). Both of Sanderson’s requests are being analyzed by the bodies to which they were forwarded.
In addition to the letter to the PGR, Girão signed an impeachment request against Toffoli sent to the Board of Directors of the Federal Senate. The piece is written by colleagues Damares Alves (Republicanos-DF) and Magno Malta (PL-ES). According to the request, in addition to a “conflict of interest” with the facts investigated under his report, Toffoli should be removed from office for “atypical procedural acts”, such as a request for a premature confrontation between representatives of the Master, the Central Bank and the Bank of Brasília.
The petition has already been filed in the Senate system, but has not yet been received by the Board. Upon receipt, it must be assessed by the House’s Advocacy and then evaluated by the President of the Senate, Davi Alcolumbre (União Brasil-AP), who decides on the continuation of the representation.
In addition to the representations, Toffoli was the target of a protest this Thursday (22), organized by the Movimento Brasil Livre (MBL). The event took place in front of Banco Master’s headquarters, near Avenida Faria Lima, in São Paulo, and focused on the rapporteur’s recent decisions in the investigation. Protesters called for Toffoli’s removal.
