Moraes rejects work plan in the prison of military personnel convicted in the coup plot

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), rejected the work proposals presented by former Navy commander Almir Garnier and Army general Mário Fernandes, both convicted in the coup plot that also led to the arrest of former president Jair Bolsonaro. The plans provided for activities to “improve” military institutions, which was considered “inadequate” by the magistrate given the reason for which the two are imprisoned.

According to g1, Garnier and Fernandes asked the Court for authorization to work as a way to reduce their sentences. The admiral is serving 24 years in prison in a cell at the Navy Radio Station, in the Federal District, while the general was sentenced to 26 years and six months in detention and is currently in the Planalto Military Command, in Brasília.

Garnier’s proposal, prepared by the Naval Operations Command, involved activities such as the study of Amazon monitoring technologies, the use of simulators to measure the country’s defense capacity and the technical analysis of the procedures adopted in the evaluation of sensors, weapons, vehicles and other Navy equipment.

“Legally impossible, unreasonable and inappropriate for the defendant to participate in activities directly related to the improvement of the Armed Forces, which play an essential role in defending the Constitution, national sovereignty and the stability of the Democratic Rule of Law,” said Moraes in the order obtained by TV Globo.

The admiral was the only head of the Armed Forces who made his troops available to Bolsonaro in a meeting in Planalto, when the former president was trying to reverse his defeat in the elections through an intervention in the Superior Electoral Court. The content of the meeting was confirmed by the other commanders, Marco Antônio Freire Gomes, from the Army, and Carlos de Almeida Baptista Júnior, from the Air Force, in testimony to the STF.

The STF minister ordered the Naval Operations Command to present another work plan that preferably involves the administrative area of the body, as the military wants. Garnier also asked for access to literary works and enrollment in higher education and professional courses, activities that, in the same way, serve to reduce prison time.

Fernandes intended to carry out “intellectual” services for the Army’s Directorate of Historical and Cultural Heritage and the Army Doctrine Center, based on the reading of historical works and technical research, but his proposal was also denied. The Planalto Military Command was also asked to redo the plan, focusing on the administrative area, and submit it again to the Supreme Court for scrutiny.

The Army general’s role in the coup plot was to prepare an assassination plan against authorities, including Moraes himself, together with special agents known as “black kids”. The document, called “Punhal Verde e Amarelo” was printed on the premises of Palácio do Planalto before Fernandes went to the president’s official residence, Palácio do Alvorada.
