
Podemos revealed the news this Monday: the Council of Ministers will approve this Tuesday a r that could benefit more than 500,000 people. “There are people in Spain who live in fear of being stopped by the police,” said Irene Montero, MEP of the party during an event in Madrid. So far the content of the document that the Executive will soon present is not known, but there are already several clues on the table about its content.
Who is affected?
The regularization will benefit people in an irregular situation and asylum seekers who prove they are in Spain before December 31, 2025. That is, it is expected that interested parties will be able to start their application starting this May. The estimated number is half a million people. It is not the first to be carried out in Spain (from 1986 to 2005: three in the socialist government of Felipe González, four with José María Aznar and one with the PSOE of José Luis Zapatero) that affected more than a million people.
How can permanence be proven?
To prove your stay in the country, you may provide documents such as the register, reports of medical appointments, certificates of assistance to social resources, a rental contract, proof of money transfers or transportation tickets.
Is there any more requirement needed?
Podemos has explained, and Government sources have confirmed to this newspaper, that, in addition to the accreditation of having lived in Spain since before next May, not having a relevant criminal record will be another requirement to benefit from regularization.
The possibility of deportation during the process
One of the guarantees that Podemos has advanced is that, at the time of submitting the regularization request, return procedures or expulsion orders will be automatically suspended for administrative reasons or for working without permission that affect the person in an irregular situation. When admitted for processing, a provisional residence authorization will be granted that allows you to work legally and access other fundamental rights, such as health care. If the resolution is favorable, the State will grant a residence authorization for a period of one year and, when this ends, the affected person may request an ordinary authorization in accordance with the immigration regulations.
Will the agreement be validated in Congress?
No. The measure will be approved through a Royal Decree, so it does not need to go through Congress for validation, where it would be very difficult to obtain a majority given the refusal of the PP and Vox on this matter. After approval by the Council of Ministers through urgent processing, the document will go to a public hearing and the possible preparation of reports from various ministries. Then, the document will go to the Council of State and, back, to the Council of Ministers.
This agreement was born after more than a thousand associations fought to launch a Popular Legislative Initiative (ILP) with more than 700,000 signatures.
