Inter-American Court finds Brazil guilty in Olivetto case – 01/26/2026 – Panel

Last Friday (23), the Inter-American Court of Human Rights held the Brazilian State responsible for the , , which it claims to have suffered violations during its imprisonment in Brazil.

Currently represented by the DPU (Federal Public Defender’s Office), he was arrested in Brazil on February 1, 2002 and subjected to a different disciplinary regime between February 2002 and February 2007.

, was kidnapped in December 2001. He was taken when leaving his advertising agency, W/Brasil. The publicist remained in captivity in Brooklin (south zone of São Paulo) until February 2, 2002 and was released after a neighbor heard his screams.

The Ombudsman sought recognition of the international responsibility of the Brazilian State for the following violations provided for in the American Convention on Human Rights: personal integrity, equality before the law, non-discrimination, judicial protection, judicial guarantees and honor and image.

The IACHR recognized the State’s responsibility for the conditions of detention and declared the State responsible for the lack of adequate justification for the decisions that led to the application of the differentiated disciplinary regime to Norambuena.

It also considered that there was a lack of access to effective judicial resources to question the application of this regime.

After the differentiated disciplinary regime, the Chilean was transferred to the Federal Penitentiary System, where he remained from February 3, 2007 to January 29, 2019. In August of that year, he was extradited.

A medical assessment carried out in Chile by the Department of Human Rights of the Medical College of Chile and the National Institute of Human Rights found significant impacts on his physical and mental health due to the prolonged isolation and incommunicado regime to which he was subjected.
