That case is yet to be judged for humiliation, threats and mistreatment, but the now detained man violated the restraining order issued, so on December 3 he was sentenced to four months in prison by the same court. “The accused accepted the facts and was satisfied with the sentence imposed for the violation,” the TSJA emphasizes, where they explain that entry into prison was suspended for two years with the condition that the convicted person did not commit any crime. By then she had already filed for divorce to separate. The couple has three children together: an eleven-year-old boy and two eight-year-old twins.

Despite the judicial situation, the man continued to harass his now ex-partner. And this Saturday he went to the family home around eleven in the morning and attacked her with a kitchen knife while her son and daughters were in the house. It was the victim herself who screamed for help, which alerted the neighbors, who called the 112 Andalucía Emergency service while one of them managed to enter the house and found Victoria surrounded by a pool of blood, lying on the floor next to a knife. When the health services arrived they could only certify his death.

The man surrendered at the Alhaurín de la Torre prison and was detained by the Civil Guard. This Tuesday, the same court that had tried him, competent in Violence against Women, has decreed his entry into provisional prison, communicated and without bail. The detainee is being investigated for the crime of homicide and another crime of violating the restraining order with respect to the victim. In addition to ordering his imprisonment, the judge imposed a restraining order and a prohibition on communication with his children and agreed to suspend his parental rights. The arrested person, according to legal sources, took advantage of his right not to testify while waiting to have a private lawyer and requested to be examined by a doctor about his mental situation.
