The union and the president’s brother, who is a director of the institution, asked for Nunes’ posts critical of the discounts applied to retirees to be removed from the air.
One of the councilor’s posts said: “Discounting retirees by force has become a family business: Lula’s brother earned R$100 million more in 3 years. In Lula’s Brazil, even robbing old people is a social project, the new type of Bolsa Família is the ‘Bolsa Desconto Devido’!”
In the decision, judge André Bezerra, from the 42nd Civil Court of the Central Court of São Paulo, understood that the legal requirements to restrict the councilor’s demonstration were not present. He pointed out the risk of violating freedom of expression, guaranteed by the Constitution.
“They tried to use the Judiciary to silence me for reporting discounts made against retirees. The Court was clear in rejecting any attempt at censorship. Criticizing the union is not a crime, it is a public duty”, declared the councilor. The decision may be appealed.
