According to current legislation, no candidate You can run for elected office without being affiliated with a regularly constituted political party.
With a focus on , only associations that have their statutes registered with the TSE (Superior Electoral Court) at least six months in advance of the election will be able to launch candidates. This registration is also a condition for parties to have access to Party Fund resources and free advertising time on radio and television.

Rules for creating and registering parties
The creation, organization and functioning of political parties in Brazil are regulated by Lei nº 9,096/1995known as the Political Parties Law, and by resolutions of the .
The legislation guarantees freedom to create new parties, as long as their programs respect principles such as national sovereignty, democratic regime, multi-party system and fundamental rights.
After acquiring legal personality through civil means, the party must register its status with the TSE.
Support and foundation requirements
For a party in formation to be able to register its statute, it is necessary to prove, within two years, the support of voters not affiliated with other parties.
This support must correspond to at least 0,5% of the valid votes cast in the last general election for , distributed across at least one third of the states.
Furthermore, the creation of a party requires the participation of at least 101 founders, all with political rights and electoral domicile in at least one third of the Federation units.
It is up to these founders to prepare the party’s program and statute, in addition to electing the provisional national board responsible for conducting the registration process.
