Amid the image crisis of the (Federal Supreme Court) due to the repercussions of the investigation into , the president of the court, , invited ministers to a meeting on February 12th.
Officially, the meeting — a lunch on the court premises — is a get-together between colleagues to mark the opening of the judicial year. However, there is an expectation that for ministers it will be one of the main issues.
As Folha showed, the vote on the proposal on the implementation of a code of conduct for ministers, in a strategy to buy time and try to obtain a unanimous result.
The president of the STF has considered with the team that, even with possible reservations, the agreement of all ministers would give more institutional strength to the guidelines and show that the court is united on the public ethics agenda.
The code of conduct is one of the measures defended by the President of the Supreme Court to address the wear and tear that is accumulating in public opinion, mainly in relation to ministers Dias Toffoli and Alexandre de Moraes.
Toffoli, rapporteur of the Master’s investigation, is at the center of the STF’s crisis, due to the relationship with one of the lawyers in the case, the secrecy imposed on the case and, as revealed by Folha.
Moraes is also identified as having a wear factor, mainly due to defending the interests of the financial institution. The STF does not comment on these episodes.
A group of ministers understands that Fachin’s offensive in favor of the code of conduct takes place at a troubled time, leaving magistrates and the court itself subject to a new wave of attacks, precisely at the moment when criminal proceedings over the coup plot were concluded.
Despite this, the diagnosis made by Fachin is that the next few months could end up being positive so that he can better articulate with his peers, be able to overcome internal resistance and obtain the support of all his colleagues, even if there are occasional disagreements.
In an attempt to persuade his colleagues, Fachin stated that it was his own, but society’s demand for more integrity. The president of the STF and spoke with all the ministers over the last few days.
