O Superior Court of Justice (STJ) revoked, this Monday (2/2), the habeas corpus injunction that kept the rapper Oruam in freedom. The decision paves the way for the musician to be returned to prison if a new warrant is issued.

Why habeas corpus was revoked
In the decision handed down in February 2the STJ definitively denied habeas corpus after finding non-compliance with imposed measures. According to the rapporteur, electronic monitoring showed 28 outages in just 43 daysmainly during nights and weekends, compromising judicial supervision.
The court understood that the failures cannot be treated as mere technical problems.
Defense manifests
Oruam’s defense claimed that the interruptions occurred due to battery charging problems of the anklet. However, the rapporteur stated that the justification is fragile and cannot be sustained given the frequency and pattern of occurrences.
According to the minister, the artist’s conduct represents risk to public order and the application of criminal law, in addition to demonstrating lack of commitment to judicial decisions.
Effects of the decision
With the revocation of the injunction, the preventive detention takes immediate effect again. A letter communicating the decision has already been sent to the Rio de Janeiro Court of Justicewhich may issue a new arrest warrant.
The case rapporteur is the minister Joel Ilan Paciornikthe same person who had granted provisional freedom to the rapper in September.
