Deputy proposes changes to the ECA to toughen penalties in cases of violence against animals

Federal deputy Rosana Valle (PL-SP) presented a Bill (PL) that amends the Child and Adolescent Statute (ECA) and expands socio-educational measures in cases of violence against animals.

In an interview with Young Panthe parliamentarian explained this Wednesday (4) that the ECA does not provide for hospitalization for an infraction similar to the crime of extreme cruelty to animals.

“Today, as stated in the ECA, cases of violence against animals are not classified. It is extreme cruelty. This needs to be urgently changed. It is a gap in the ECA regarding animal cruelty”, stated Rosana Valle.

In Brazil, the ECA establishes the rights and socio-educational measures applicable to minors. Illegal conduct carried out by adolescents is classified as an infraction and can lead to sanctions such as probation or, in extreme cases, hospitalization, which is the most rigorous measure provided for by legislation.

This punishment, however, is only permitted when there is proof of violence or serious threat, recurrence of serious infractions or non-compliance with previously imposed measures.

Representative Rosana Valle also stated that she is working with the Liberal Party so that the bill is urgently scheduled in the National Congress.

“It is a possible and objective modification. I am not discussing the application of the ECA, I am discussing a gap in the law”, he declared.

According to the parliamentarian, the ECA does not provide for hospitalization in cases of cruelty against animals. She cited article 122, which conditions the measure to situations of serious threat or violence only against humans, and not animals.

The PL presented by Rosana awaits receipt from the Board of the Chamber of Deputies so that it can then dispatch and indicate the committees responsible for analyzing the text and subsequent discussions.

Police request hospitalization of teenager involved in Orelha’s death

The Civil Police of Santa Catarina concluded this Tuesday (3) the investigations into the death of Cão Orelha and the mistreatment of the caramel dog and requested the hospitalization of the teenager involved in the case. “Four teenagers were represented in the Caramelo case and “, says a police note. “In addition, in the Orelha case, three adults were charged with coercing a witness”, he adds.

In the note, the Civil Police indicates that it took more than a thousand hours of analysis of footage from the regionon the 14 pieces of equipment that captured the images. “24 witnesses were interviewed, 8 teenage suspects were investigated, in addition to evidence such as the clothes worn by the perpetrator, which was recorded on film,” they explain.

According to the information collected, the The dog Orelha was attacked in the early hours of January 4th, around 5:30 am in Praia Brava, in the North of the Island. “The unfolding of the events began at 5:25 am, when the teenager left the condominium in Praia Brava. At 5:58 am, he returned to the condominium with a female friend”, they pointed out.

This was one of the points of contradiction in the teenager’s speech, as he lied in his statement saying that he stayed in the condominium, in the pool. However, as the police have access to the images, they saw him leaving the place. In addition to the images, witnesses and other evidence proved the teenager’s departure from the scene.

The case of mistreatment against the dog Orelha, around 10 years old, generated public commotion in recent weeks. The cPraia Brava Community Achorroin Florianópolis, Santa Catarina, died after being attacked by teenagers.

On Monday, January 26th, through the Animal Protection Police Station (DPA) and the Adolescent Assistance Police Station in Conflict with the Law (Deacle), the Santa Catarina Civil Police carried out search and seizure warrants at the homes of those involved and their legal guardians. Corporation agents also did searches of addresses linked to “adults investigated for alleged coercion related to the progress of the process”.
