Elisa Mouliaá withdraws from the ‘Errejón case’ for health reasons: “I cannot continue alone” | Spain

The actress Elisa Mouliaá has informed the judge this Wednesday that she “totally, freely, consciously and irrevocably desists from the private accusation” that she exercises in the case opened in the courts of Madrid () against the former deputy Íñigo Errejón for an alleged sexual assault. In a writing, to which EL PAÍS has had access, the artist has explained that she adopted this decision “for strictly personal and health reasons” and that “it is not due to a retraction of the reported facts.” “I can’t continue alone,” she told this newspaper. The future of the case is pending after this movement: although she is withdrawing and the Prosecutor’s Office decided not to accuse, a popular accusation intends to move forward.

Mouliaá denounced Errejón in October 2024. She accused him of having sexually assaulted her during a party at a friends’ house in September 2021. In her complaint, she stated that the former politician kissed her without her consent when they were in an elevator and, later, put her in a room of the house, locked the door, touched her numerous times and showed her “his virile member.” Some time later, they both drove to the former politician’s house, where, according to Mouliaá’s story, he again insisted on maintaining relations. But she, at that moment, criticized his behavior and reproached him for making her feel uncomfortable and violated.

Mouliaá’s complaint coincided with several accusations from other women that were made public through journalist Cristina Fallarás () who pointed to “a politician who lives in Madrid.” The allusions were directed to Errejón. Regarding this, Mouliaá stressed this Wednesday in his writing that throughout the process in the courts “none of the other people have decided to appear in the exercise of criminal action”, which has “increased” their “sense of exposure and personal exhaustion.” Thus, he has insisted that his decision to withdraw his accusation “does not imply any recognition of falsehood, nor the formulation of new accusations.”

“There are many victims, none of them want to take the step and I cannot continue alone,” Mouliaá said in statements to Elena Reina. On her

The artist’s lawyer, Alfredo Arrién, has reported that his client suffered an anxiety attack this Wednesday, that she went to the hospital and that when she left the center she presented the document. Mouliaá has made this “impulsive” decision against the criteria of his legal team, according to Arrién. The lawyer has stressed that he has warned her that this step could have “terrible, bad consequences for her.” And he has assured that the procedure will continue, since it is “a public crime.”

Errejón’s defense has indicated that Mouliaá’s resignation occurs two days before her lawyer abandoned her defense because the actress wanted to “negotiate” the withdrawal of her complaint against Errejón in exchange for him doing the same with her. Mouliaá’s defense has denied these negotiations.

Errejón’s legal representation has specified that the former deputy will maintain his complaint and will continue working to “prove to the end that he is innocent.” “Elisa Mouliaá has backed down because the situation was already unsustainable, with the Prosecutor’s Office against her,” he said.

The Prosecutor’s Office decided not to accuse Errejón

It should be remembered that last December due to the sexual assault reported by the actress. The public ministry does not distrust the testimony of the actress and presenter, but considers that there is not enough evidentiary material to make an accusation against Errejón for a trial. Judge Adolfo Carretero, who led the investigation in the Madrid courts, told the former deputy weeks before when he understood that there was sufficient evidence for the trial to take place.

This Wednesday, the actress assured on her social networks that she is leaving “with a clear conscience” and that “if justice continues, because it is a public process,” it will do so without her participation. Mouliaá requested three years in prison for Errejón and demanded compensation of 30,000 euros for the damages suffered.

Jorge Piedrafita, lawyer from the Specialized Comprehensive Defense of Victims Association (ADIVE), which exercises popular action in the case, has assured that he will maintain the accusation considering that the story of the serious events, which would violate sexual freedom, is maintained. “No matter how powerful the accused is, (the facts) cannot go unpunished,” he added.

The Penal Code, in its article 191, establishes that in cases of crimes of sexual assault and sexual harassment “a complaint from the aggrieved person, from their legal representative, will be required to file a complaint from the Public Prosecutor’s Office.” However, jurists consulted by this newspaper explain that the trial can go ahead if the Prosecutor’s Office or the popular accusation does not request the file, because the judge has already finished the investigation and sent the case to trial.

In this case, the public ministry has already requested the acquittal of the former deputy, while the popular prosecution has announced that it will continue with the accusation. The sources consulted explain that, as it is a public crime, the accusations must state in writing if they do not wish to continue. In the coming days, the judge will have to decide what to do with Mouliáa’s resignation letter and determine whether or not the case will finally end in trial.

The communication in X from the complainant, where she has posted photos with the document, comes two weeks after she announced on that same social network that . “From here I want to publicly record that Sumar has contributed significantly to defraying the costs of my judicial process. A gesture that shows the political responsibility that should be assumed in a general way. Because responsibility is not proclaimed, it is exercised,” Mouliaá wrote.

A spokesperson for the party then recalled that at the time they made themselves “available to the victims,” that some of them contacted them to ask for “financial support for the lawyer” and the political group gave it to them. This Wednesday, Sumar sources have limited themselves to conveying “total respect for his decision,” reports Paula Chouza.
