Lula defends creating a mandate for STF ministers – 02/05/2026 – Politics

The president (PT) defended this Thursday (5) discussing the creation of a mandate for ministers of the (Supreme Federal Court) when asked about the need for reform in the Judiciary.

In an interview with the portal Uol, he stated that “it is not fair” for a minister to be appointed at 35 and remain on the court until 75, the mandatory retirement age. “It’s a long time,” he declared. The president stated that the issue should be addressed by the .

“Everything needs to change and nothing is free from change. During the [Fernando] Haddad for President of the Republic in 2018, on the program, was the issue of the mandate for the Supreme Court. I think we need to discuss this. It is also not fair for a person to enter at 35 and stay until 75. In other words, it’s not fair. It’s a long time. So, I think there may be a mandate. But this is a process to be discussed in Congress,” he said.

It is up to the President of the Republic to nominate a vacancy in the Supreme Court. The name is examined by the CCJ (Constitution and Justice Commission) and must be approved by the plenary of the Upper House.

This is not the first time that Lula has defended the creation of a mandate for STF ministers. In 2013, he said that the STF mandate model would have the advantage of “alternation”.

“We need to decide the issue of the Supreme Court. Whether it will have a mandate or not, whether it will last for 75 years, whether it will stay as it is. Because otherwise people will stay for 40, 35 years. I think we could consult the OAB. It could have a mandate. It’s something that has to be discussed”, he said after an event at the OAB (Brazilian Bar Association), in honor of the Constitution’s 25th anniversary.
