The TJ-SP (Court of Justice of ) sentenced the federal deputy (-SP) to pay compensation of R$30,000 to the mayor of São Paulo, (), for offenses during the 2024 electoral campaign.
Nunes asked for compensation for moral damages due to a debate between the candidates for Mayor of São Paulo that year, in which the deputy said that the opponent should adopt the slogan “steal and don’t do it”. In May 2025, , but the mayor appealed.
This Wednesday (4), the 8th Chamber of Private Law of the TJ-SP decided for the conviction. Judge Ronnie Herbert Barros Soares, rapporteur of the case, considered that Tabata’s statement “violates common sense” and is not a “mere manifestation of criticism or exercise of freedom of expression”.
In a press release, the deputy’s office states that she was aware of the TJ-SP’s decision and that she will appeal to the higher courts. “The parliamentarian disagrees with the understanding adopted, given that, during the 2024 electoral campaign, she publicly pointed out what is documented in investigations, reports and formal complaints”, he says.
It also says that she “will continue to defend transparency, public interest and the right of São Paulo society to know and discuss, in a frank and responsible way, the facts related to the city’s management”.
According to the decision, Tabata’s conduct was aimed at obtaining a specific effect on the electorate and highlights that the deputy used the video cut on social media.
“This strategy made it possible to reuse, from the extensive content, the short fragment, which is easy to consume on social networks, where the defendant has more than 1.5 million followers”, says an excerpt from the decision.
