The young woman who accuses the Minister of the (Superior Court of Justice) Marco Aurélio Buzzi of sexual harassment told the São Paulo Civil Police that he took her to a secluded area of a beach, touched her without consent and then advised her to be “less sincere”.
A Sheet had access to the statement given by the 18-year-old girl on January 14th.
Marco Buzzi, 68, is on leave from court for health reasons and denies the accusations. The minister was admitted to the DF Star, in Brasília, this Thursday (5), one day after the CNJ confirmed that he is the target of representation for harassment.
In a note released on Wednesday (4), the minister stated that “he was surprised by the content of the insinuations published by a website, which do not correspond to the facts”. He also said that he repudiates “any and all conclusions that he committed an improper act.”
According to the statement from the 14th, the episode occurred on January 9th, at Estaleiro beach, in (SC). The young woman was staying with her parents at the minister’s beach house.
According to the report, the young woman and the minister went to the beach while the young woman’s parents and the minister’s wife finished chores at the residence.
After spending time on the sand, Buzzi invited her to go into the sea and suggested that they go to the left side of the beach, stating that the sea would be calmer there. The young woman found the justification strange, as she thought the sea was not rough where they were.
The location chosen by the minister had no visibility of the umbrella that the other participants on the trip could be under if they decided to go to the beach, according to the statement.
Already in the water, in a deep area, Buzzi would have asked the young woman’s age. He then commented that he was cold and pointed to a couple hugging nearby.
Then, according to the report, the minister grabbed her arm, turned her back and pressed his body against hers. He stated that he thought she was “very beautiful”. When she tried to free herself, he pulled her again, according to the document.
The young woman claimed to have managed to get away after some attempts by the minister to pull her.
Shortly after he released her, according to the statement, Buzzi stated: “You are very sincere, you should be less sincere with people. I only see the relationship with your mother, but you are very sincere, you should be less. This could harm you.”
Then, when they left the sea, the young woman declared that she reached the umbrella, told her mother that she needed to work, covered herself with a towel and ran to the condominium. There, he told his father what happened, according to the statement.
The family left the minister’s house on the same day.
According to the document, the young woman had attended the STJ since childhood and considered the minister “a grandfather and confidant”. Her mother works in the higher courts, and the professional relationship evolved into friendship between the families.
The young woman told the police that, since the incident, she has been unable to sleep and is being monitored by a psychologist and psychiatrist.
The STJ opened an inquiry to investigate the case. The commission is formed by ministers Raul Araújo, Isabel Gallotti and Antônio Carlos Ferreira. At the (Federal Supreme Court), the criminal investigation is being reported by Minister Kassio Nunes Marques.
The young woman went to the CNJ (National Council of Justice) this Thursday and reinforced that the magistrate had committed the act. The complainant gave a detailed account of the episode on video.
The hearing was led by an advisory judge and had the participation, remotely, of the national inspector of justice, Mauro Campbell.
