The decision by Federal Supreme Court minister Alexandre de Moraes to authorize the opening of an investigation against senator Flávio Bolsonaro (PL-RJ) generated a reaction from the parliamentarian, who classified the measure as “legally fragile” and without criminal law.

When authorizing the investigation, Moraes highlighted the reach of the publication and the fact that the content was published in an open environment, with wide circulation. The minister noted that criminal practices were attributed to the President of the Republic, which justifies the investigation for alleged slander.
In the statement sent to the Supreme Court, the Federal Police pointed out that the post not only mentioned a political scenario, but directly associated Lula with illicit conduct, which supported the request to open an investigation.
In a note, Flávio Bolsonaro stated that he did not directly impute a crime to the president and that his publication was limited to reporting facts involving Nicolás Maduro. “The measure is legally fragile, since the publication subject to the procedure lacks any criminal nature,” he said.

The senator also stated that the decision represents an attempt to restrict his parliamentary activities. “The opening of this investigation constitutes a clear attempt to restrict freedom of expression and the free exercise of the mandate”, he declared.
In the same statement, Flávio compared the case to decisions taken during the 2022 elections, criticizing what he considers to be unequal treatment by the Electoral Court. He also stated that he will continue criticizing the government and demanded explanations about Brazil’s relations with Venezuela.
The investigation was forwarded to the Federal Police, which will have an initial period of 60 days to carry out the investigations.
