The president of the House of Representatives, stated that there was a distortion of the discussion about the And that if the Senate considers that the bill should not prosper, that it archives it. “Seeing all this discussion is distorted, PEC of Armage, Pec of this and that, is not correct. As mayor, respect the position that the Senate will have in relation to PEC. It is a duty of the Senate. If the Senate thinks PEC is not interesting, to vote against, archive,” he said during the Macro Day conference, held by Banco BTG Pactual, on Monday (22) in Sao Paulo.

Motta said that there is a “advance” of the judiciary in the mandates of the congressmen and mentioned that there are deputies prosecuted for crimes of opinion, the use of social networks and speeches in the Chamber’s podium. According to him, the House only resumed rules provided for in the 1988 Constitution and of which the Legislature gave up. For him, the proposal is not intended to shield parliamentarians, but to protect his mandates from “absurd”.

“Since the approval of the Constitution, in 1988, no power except the legislature has gone up their prerogatives. Neither the Executive Power nor the judiciary gave up. With reason. The Legislative Power has given up the original constitutional text, by a punctual fact, it was there in 2001, which decided to change the authorization model to support criminal action,” he said. The House approved last week the “PEC of Armagem”, under the rapporteur of Deputy Claudio Cajado (PP-BA). Voted 353 votes favorable and 134 opposites in the first round of the vote and 344 favorable and 133 against the second. 308 votes were needed.

The PEC rescues the “prior license”, a device that gave the National Congress the possibility of blocking the opening of criminal proceedings against its members. The mechanism was in the 1988 Constitution and was removed in 2001. With the “PEC of Armage”, Congress has the prerogative of authorizing or not, by secret vote, not the opening of a process or an order of arrest.
