Advisor Ulisses Rabaneda, from the (National Council of Justice), considered illegal and overturned an administrative decision made by a judge who is also a member of the body.
Rabaneda decided, in September, to reverse the cancellation of land registrations in the west of , which had been determined by the General Inspectorate of the State Court of Justice.
His determination drew attention internally because Bahia’s general inspector of justice at the time was José Edivaldo Rotondano, currently a member of the CNJ.
The region is known for and was the location of one of the largest judicial decision sales operations in the country, .
In the decision, Rabaneda says that there are still ongoing legal proceedings on the matter and that the administrative cancellation conflicts with these actions. He decided that registrations will only be blocked, not cancelled, until the fight in court is resolved.
“The autonomy between the instances does not authorize the administrative authority to ignore the existence of a judicial process dealing with the same controversy, especially when the real rights of third parties and issues of high factual complexity are at stake,” he said in the decision.
And he gave a scolding: “Prudence and deference to the jurisdictional function required that the General Inspectorate of Justice of the State of Bahia limited itself to maintaining the precautionary block on registrations, awaiting the definitive solution of the dispute through the jurisdictional route.”
Rotondano is also campaigning to become president of the Court of Justice of Bahia in a term that runs from 2026 to 2028.
When contacted, Rabaneda declined to comment. Rotondano’s press office stated that he was not the author of the blockade and that he only maintained the decision of other judges.
Furthermore, remember that, at the CNJ, two other counselors maintained the decision.
“In a new assessment, a new advisor replaced the blockade, as he understands that there are new elements”, says the note, which also states that the case is not new and that it is fake news propagated, “in an electoral maneuver, by another competitor [na disputa da Bahia]”.
“There is no legal instance of any accusation involving judge Rotondano, who is also an advisor to the CNJ”, he continues.
