The Court of Justice of (TJ-SC) determined this Thursday (30) that the businessman, owner of Havan, pay compensation for moral damages to the president (PT) for having displayed, on banners carried by planes on the coast of Santa Catarina, phrases offensive to the PT member.
The businessman will have to pay R$33,333.33 to the PT member.
In the summer of 2019 and 2020, he paid for planes to fly over the coast of Santa Catarina with banners offensive to the PT member. In the decision, the TJ-SC assessed that the owner of Havan violated Lula’s honor and image.
In April 2023, in the first instance, the Court had considered the request for compensation for moral damages made by the president’s defense as unfounded, understanding that, as he was a public figure, Lula would be subject to criticism. The judge who judged, at the time, stated that “living with denunciations, accusations and harsh criticism” would be inherent to political life.
For the lawyers who filed the lawsuit, Angelo Ferraro and Miguel Novaes, Hang’s initiative went beyond the limits of freedom of expression and amounted to a personal attack.
The court argued that, even though Lula is a public figure and the target of intense political debates, he has the right to the protection of his honor and image. Therefore, Hang should be ordered to pay compensation. The businessman can still appeal.
When contacted by the Panel, Hang’s defense team did not comment.
