New president of the (Court of Justice of the State of), judge Francisco Eduardo Loureiro stated this Monday (2) that the court will maintain the remuneration policy for magistrates, including the so-called penduricalhos.
“Payments, compensations are maintained, as well as subsidies. There will be no change in salary policy”, stated Loureiro in an interview with journalists after an event promoted by IASP (São Paulo Lawyers’ Institute).
The salary ceiling for the state judiciary corresponds to 90.25% of the salaries of ministers of the (Supreme Federal Court), which is more than R$46 thousand. In practice, however, TJ-SP judges and judges pocket amounts above this limit.
Magistrates are entitled to figures guaranteed by laws, court decisions and administrative acts that authorized additional payments that, added to the basic remuneration, increase the final earnings beyond the ceiling.
These funds include various compensations, such as food, health, housing and allowances, but also other retroactive rights.
“I don’t use the term penduricalho. We have subsidies. The subsidy is what we receive within the ceiling of the Supreme Court. And we have, as any worker has, funds to receive relating to past periods and these funds relating to past periods are paid in installments”, stated Loureiro.
“All, without any exception, based on either federal law or rulings of the Federal Supreme Court or based on a decision of the Federal Supreme Court. Nothing is paid, not a penny is paid, without there being either law, or a decision of the Supreme Court, or normative authorization from the National Council. Not a penny is paid beyond that”, he added.
