The defense of the general, former minister of the Civil House in the government of Jair Bolsonaro (PL), asked the minister of the (Supreme Federal Court) authorization for access to cable television and to take a distance higher education course, with the aim of reducing the sentence.
According to the document, the general expressed interest in studying a degree offered by Faculdade Estácio, chosen because it is aligned with the pedagogical project of the military unit where he is serving his sentence.
Braga Netto was arrested in December 2024 by the Federal Police, being sentenced in September 2025.
The defense asks that he be able to carry out distance learning studies, as provided for in the Criminal Execution Law.
“Thus, authorization is required for enrollment and completion of the aforementioned course, as a form of remission of sentence, recognizing education as an instrument of resocialization and social reintegration,” he said in the document.
Furthermore, lawyers require authorization for Braga Netto to have access to cable television. The argument is that the measure would be related to the resocializing function of the sentence and the custodian’s right to remain linked to social reality by following news channels.
The defense highlights that the general is the only prisoner in the military unit, which would result in a routine without interpersonal interaction. The costs of hiring, installing and maintaining the service, according to the petition, would be entirely borne by the prisoner himself.
Among the requests, the lawyers request authorization to carry out visits from seven people already registered with the 1st Army Division of the Eastern Military Command.
The defense also reported that it does not oppose the visit request made by senator Hamilton Mourão, highlighting that he is also registered in the military unit where the general is held.
