Toffoli and PF have a history of disagreements in the Master case; understand

The director general of the Federal Police, Andrei Rodrigues, handed over to the president of the Federal Supreme Court (STF), Edson Fachin, information from the cell phone of Daniel Vorcaro, owner of Banco Master, which includes mentions of Minister Dias Toffoli, rapporteur at the Court of the case involving the financial institution.

There are no details about the content, which is confidential. The information was revealed by UOL and confirmed by GLOBO.

After receiving the material from the PF, the president of the STF forwarded the document to the minister to answer whether there were conflicts of interest in his role as rapporteur of the Master’s investigation at the Court. In a statement, Toffoli denies any irregularity and says that the request deals with “inclusions”.

“Minister Dias Toffoli’s office clarifies that the request for a declaration of suspicion presented by the Federal Police deals with conclusions. Legally, the institution does not have legitimacy for the request, as it is not a party to the process, under the terms of article 145, of the Civil Procedure Code. As for the content of the request, the response will be presented by the Minister to the President of the Court”, says the note.

This is not the first clash between the PF and Toffoli in investigations related to the Master case. See other situations in which the minister and the corporation differed:

Confrontation

There was a disagreement during the confrontation held in December 2025 between businessman Daniel Vorcaro and the former president of the BRB, Paulo Henrique Costa, followed by the testimony of the BC’s inspection director, Ailton Aquino.

The PF delegate who conducted the testimonies, Janaína Palazzo, and the assistant judge from Toffoli’s office, Carlos Von Adamek, disagreed on the conduct of the hearings. The assistant judge gave the delegate a list of Toffoli’s questions that should be asked, to which Palazzo disagreed and stated that it would be up to the PF to conduct the interrogations. Adamek then called the STF minister, who ordered the delegate to ask the questions on the list as if they were his.

To Ailton Aquino, director of supervision at the Central Bank, the delegate asked two questions from Toffoli’s list. One of them, about possible new measures to be taken in relation to Master after the extrajudicial liquidation, was not answered by Aquino. The BC attorney general, Cristiano Cozer, who accompanied Aquino, asked to speak and said that the question was “speculative” and “vague”.

Evidence

On January 14, Minister Toffoli once again made a controversial decision: he determined that all materials seized during the second phase of Operation Compliance Zero, which took place on the same day, were “sealed” and “safeguarded” on the premises of the STF.

The second phase of Compliance Zero seized 39 cell phones, 31 computers and 30 weapons during the execution of warrants. Among the targets were banker Daniel Vorcaro, his brother-in-law, investor and evangelical pastor Fabiano Zettel, and investor Nelson Tanure. At the time, Zettel was detained when he was at an airport heading to Dubai, in the United Arab Emirates.

When the decision was made to store the evidence at the STF, PF investigators involved in the investigation told GLOBO that the decision could create a risk of losing relevant evidence, as cell phones and electronic devices could be erased remotely.

Then, on January 14, Minister Dias Toffoli authorized the Attorney General’s Office (PGR) to extract and analyze all the material seized in the operation involving the Master bank.

The following day, the minister indicated that four PF experts could have access to the evidence being analyzed with the support of the Attorney General’s Office (PGR), responsible for the material.

The PF extracted data from phones, including Vorcaro’s, using two programs — one Israeli and one American — that can break the device’s password and access a large part of the files, although not all of them.
