The São Paulo Court of Justice ordered the suspension, within two days, of rules established regarding students’ appearance, haircut and uniform use.
The preliminary decision, handed down by judge Paula Narimatu de Almeida and published this Thursday (12), meets the requests of the Public Ministry and the State Public Defender’s Office.
The judge says that her decision does not prevent the continuity of disciplinary activities of military personnel in schools, as provided for by the law that established the model. However, it suspends documents attached to the program “Student Conduct and Attitude Guide, Uniform Wearing Guide and Citizen Values Project Guide”.
The judge understood that the rules set out in this guide violate the principle of legality and may be discriminatory. Almeida reproduces excerpts from standards that provide, for example, for a discreet and unshaved haircut, prohibiting designs, colors, topknots or mohawks. They also prohibit the use of mustaches, goatee and beards.
For students, there are recommendations to keep their hair tied up in a bun, braid or ponytail, as well as avoiding “tererê style accessories”.
For the judge, such rules and guidelines can mainly impact black and LGBTQIAPN+ students. She also says that the measures are not useful.
“Afro-Brazilian cultural expressions, such as traditional hairstyles, specific braids or cuts characteristic of the culture, may be indirectly prohibited by requiring ‘natural colors’ and ‘discreet tones’, as well as by prohibiting ‘terêrê style accessories, among others'”, wrote Almeida.
