The Public Security Commission of the Chamber of Deputies approved this Tuesday (10) a request that asks the Federal Supreme Court (STF) to analyze the transfer of former president Jair Bolsonaro (PL) to house arrest. The proposal was included in a joint vote on requests and ended up being approved en bloc by the board.
The request was presented by deputy Osmar Terra (PL-RS), former minister in the Bolsonaro government. In the document, the parliamentarian states that there is concern about the former president’s health status and asks the Supreme Court to evaluate measures that guarantee medical care considered adequate.
In the text, Osmar Terra maintains that Bolsonaro’s clinical condition has worsened since he began serving his sentence in Brasília. The application also mentions an episode that occurred in January, when the former president allegedly suffered a fall with head trauma.
According to the deputy, medical reports would indicate the need for continuous monitoring and specialized care. In the parliamentarian’s assessment, this type of care would not be fully available in the prison environment.
Last month, a Federal Police report concluded that Bolsonaro meets the conditions to remain in prison. The document, however, indicated the need for improvements in access to health services within the unit.
The analysis was considered by the Supreme Court when examining requests related to the former president’s custody conditions.

STF has already rejected domicile request
Earlier this month, minister Alexandre de Moraes denied a request from Bolsonaro’s defense that he be transferred to house arrest.
In the decision, Moraes stated that the necessary medical care can be provided in the unit where the former president is detained, known as Papudinha, in the Papuda complex, in Brasília.
The minister highlighted that the prison has permanent medical assistance, access to the Mobile Emergency Care Service (Samu) and continuous monitoring of the health status of inmates.
The decision was later confirmed unanimously by the First Panel of the STF. In addition to Moraes, ministers Flávio Dino, Cristiano Zanin and Cármen Lúcia voted to maintain the prison.
Supreme Court decision
Upon approval by the committee, the document will be forwarded to the Board of Directors of the Chamber. It will be up to the President of the House to decide whether the request will be formally sent to the STF.

Even if this occurs, the request is only suggestive in nature. Indications approved by committees or the plenary of Congress do not have binding effect, which means that the court is not obliged to adopt the measure recommended by parliamentarians.
