Any form of act carried out against children to harm their mother is considered a crime; project goes to the Senate
The Chamber of Deputies approved this Wednesday (March 18, 2026) the PL (Bill) that alters to include vicarious violence among the definitions of domestic and family violence. The text goes to the Senate.
Vicarious violence is any form of violence committed against a child, dependent or even another relative or person in the woman’s support network with the aim of harming the woman.
The text, written by the deputies (PSD-RJ), (PT-RS) and (PSOL-RS), establishes a prison sentence of between 20 and 40 years.
The measure applies when the crime is committed against the woman’s descendants, ascendants, dependents or stepchildren with the specific objective of causing her suffering, punishment or domestic control.
The penalty can be increased if the murder is carried out in the presence of the woman, against children, teenagers, the elderly and people with disabilities, or even if the aggressor is not complying with a protective measure at the time of the crime.
In justification, the rapporteur of the proposal, deputy Silvye Alves (União Brasil-GO) cmentioned a recent case ofin the interior of Goiás. On February 11, the Government Secretary of the city of Itumbiara, Thales Machado, shot his 2 children in the residence where he lived and then took his own life.
One of the boys, aged 12, died before he could be rescued. The younger brother, aged 8, was taken to hospital in a very serious condition, but died 2 days later.
