In the decision, Moraes stated that the request “lacks any legal viability” and reinforced that the measure does not change the sentencing regime, which remains closed. According to him, the authorization to stay at home has an exclusively humanitarian nature, aimed at recovering health, without representing any relaxation of the sentence.

As a result, sons Carlos Bolsonaro and Jair Renan will have limited access to the residence, being able to visit only on Wednesdays and Saturdays, at previously defined times. Senator Flávio Bolsonaro, as part of the defense team, will be able to attend daily, but with a stay restricted to 30 minutes, between 8:20 am and 6 pm.

Other residents of the house, such as former first lady Michelle Bolsonaro, as well as the former president’s daughter and stepdaughter, remain with free access. Health professionals and lawyers are also authorized to enter the property, as long as they are previously registered.

During the 90-day period of house arrest, Bolsonaro must comply with a series of measures, such as the use of an electronic ankle bracelet, the ban on the use of social networks and the restriction of external visits outside the authorized list.

The minister also issued a direct warning: any failure to comply with the conditions imposed could result in the immediate revocation of the benefit, with return to prison or a hospital unit under custody.
