Bolsonaro’s defense considers appeal on home – 03/30/2026 – Politics

The transfer of () was received with relief by family members and allies of the former president, but did not contain criticism of the decision of the minister, of the (Supreme Federal Court), considered too restrictive.

At Papudinha, for example, Bolsonaro could receive allies with authorization from Moraes, moments that he used to articulate candidacies and the electoral strategy of his political field. Now, only lawyers and a smaller group of family members can visit him, and at reduced hours.

A Sheet found that one possibility considered by the former president’s interlocutors is to sue the court through writs of mandamus to try to overthrow — but this would only be done later.

For now, the speech is to prioritize Bolsonaro’s health and care for him. Allies of the former president say it is necessary to fight one battle at a time and that the transfer home was the main objective.

The understanding, behind the scenes, is that Moraes subjected Bolsonaro to a 90-day, humanitarian and temporary test, a situation that can be reevaluated after this period.

This Monday (30), with a speech by former federal deputy Eduardo Bolsonaro to assess whether there is a violation of the prohibition on the use of social networks, one of the rules of the former president’s house arrest. If Moraes understands that there was a fraud, Bolsonaro could return to the closed regime.

In the post in question, Eduardo tells an audience that he is recording his speech to later show it to his father. “Do you know why I’m making this video? Because I’m showing it to my father and I’m going to prove to everyone in Brazil that you can’t silence a movement unfairly, taking away its leader, Jair Messias Bolsonaro. Thank you very much”, he states.

More radical Bolsonarists say that the conditions imposed by Moraes and the possibility of reversing the decision at any time represent a threat to the former president and his children. In other words, there is an obligation that the family does not displease the minister, under penalty of losing the right to domicile.

Among the measures that the former president’s defense may try to overturn are the ban on visits, the 30-minute limit for conversations with lawyers and the ban within a 1 km radius of Bolsonaro’s home.

On Friday, after Bolsonaro arrived home, the former first lady (PL) told the press that her own family, like brothers, cannot visit him.

“Our family can’t. I mean family, my parents, my brothers. People from our routine. So, it’s a little more restricted, but it’s okay. The fact that he’s at home is already a source of great happiness,” he said.

Asked about looking for Moraes again to try to extend the deadline for the domicile, one day before Bolsonaro’s minister goes home, Michelle said there is no need for now. “We have 90 days, so I think things will fall into place in these 90 days.”

Regarding her and her husband’s political activity, and that she will dedicate herself to his care.

The presidential candidate (PL-RJ) even called Moraes’ decision “exotic” as it was only valid for 90 days, but said it represented a first step towards justice.

The senator also complained about the restrictions imposed on lawyers, arguing that access should be free. He also said that the ban on visits has “nothing to do with the type of health problems” the father has.

“Clearly, there is a political bias in this decision to at least make conversations and political articulations difficult in the run-up to the elections,” he told CNN on Tuesday (24).

Flávio also spoke about future legal measures. “The decision is confusing about lawyers. It restricts access to just 30 minutes on specific days, competing in a grid with 50 other convicts, as if he were still in the battalion [Papudinha]. While at home, access should be free for guidance and strategic decisions. We will have to discuss in the defense how to clarify these issues.”

One of Bolsonaro’s lawyers, Paulo Cunha Bueno stated that the temporary form of domicile was “singularly innovative”. “Regrettably, the special conditions and needs that [ex-]president’s demands are permanent and this level of care, therefore, will be demanded for life”, he added on social media.

In Papudinha, as the 19th Military Police Battalion is known, , with whom he spoke about this year’s elections, as long as it was authorized by Moraes and at a scheduled time, on specific days. Visits other than those of children, doctors or lawyers are now prohibited.

In his decision, the minister determined “the suspension of all other visits for a period of 90 days, corresponding to the recovery period of the person in custody, to protect the necessary controlled environment, mainly to avoid the risk of sepsis and control infections”.

Hospitalized since the 13th, Bolsonaro headed to the condominium where he lives in the morning, in Jardim Botânico. The former president had it in both lungs as a result of his hiccups.

For lawyers, the new rules are also more limited, as before they used to spend up to two hours with Bolsonaro and now they only have 30 minutes. They can visit you every day, from 8:20 am to 6:00 pm, but they need to be booked in advance. Flávio to have more access to his father.

The medical team has no restrictions on visits and no need for appointments. The former president’s children maintained the Papudinha scheme, with visits on Wednesdays and Saturdays at one of three intervals (8am to 10am, 11am to 1pm and 2pm to 4pm).
