The president Luiz Inácio Lula da Silva (PT) must sanction this Tuesday (31) the bill that 5 to 20 days. The expectation is that Lula will not veto parts of the text approved by the Chamber of Deputies at the beginning of March.
Reported in the Senate by Ana Paula Lobato (PDT-MA), the project defines that the increase in the license will be gradual, applied in the following ways:
- 10 days in the first two years of the law’s validity;
- 15 days in the third year of the law;
- 20 days from the fourth year of the law (2029).
The project also establishes the paternity benefit, paid by Social Security. The cost of increasing the time of absence will be around R$5.4 billion until 2030.
The cost, which is currently borne by the contracting company, will now be paid by the Social Security with the extension of the license. The change aims to avoid resistance from the private sector and equate this right to the conditions of maternity leave, which is already paid for by the federal government.
The change in paternity leave also applies to adoptive parents of children or teenagers. The project also allows parents to pay in installments, allowing them to take 50% of the period after the baby’s birth or adoption, and the remainder within 180 days.
In exceptional cases, such as the death of the child’s mother, the father will be entitled to maternity leave of 120 days. Parents’ remuneration will be full during the period of absence.
In Congress, the project faced little difficulty in processing and massive support from parliamentarians, however, it was not implemented according to the rapporteur’s guidelines. Within the government, the recently ex-minister Simone Tebet (PSB) the approval of the project, at the time, in the Chamber of Deputies: “The paternity leave of ten days from the 27th — reaching 20 days in 30 — demonstrates the maturity of the National Congress in advancing social rights, without neglecting public accounts. It equals Brazil to the world average, with forecast revenue and fiscal responsibility”, said Tebet to CNN Brasil.
