Moraes authorized investigation after PF representation regarding publication that attributed crimes to the president
The Federal Police opened an investigation to investigate whether the senator (PL-RJ) committed a crime of slander against the president (PT). The investigation was authorized by Minister Alexandre de Moraes, of the Federal Supreme Court. The initial period established for the investigation is 60 days.
The survey opened this Tuesday (April 15, 2026). The decision complies with the representation presented by the PF to the Supreme Court. Read (PDF – 161.8 kB).
Post on social network prompted investigation
The PF pointed to a publication made by Flávio Bolsonaro in January 2026. The senator published an image on social media that showed Lula associated with the president in a prison situation. In the same post, the parliamentarian stated that the Brazilian president would be denounced. The content cited alleged crimes.
The Federal Police representation indicated that the publication attributed criminal practices to the president, such as international drug trafficking, international arms trafficking, money laundering, support for terrorists and electoral fraud. The PF assessed that the content could represent imputation of crimes without presenting evidence.
Moraes’ decision cites the scope of the publication
Alexandre de Moraes based the decision on the scope of the post. The minister noted that the content was disclosed in a public environment and attributed criminal acts to the President of the Republic, which justifies the opening of the investigation.
The investigation is being processed by the STF, which concentrates investigations involving authorities with privileged jurisdiction. Senators have forum prerogative.
Federal Police investigators must gather information about the context of the publication and its repercussion, in addition to analyzing any intention to impute crimes unduly.
At the end of the initial period, the PF may request an extension, suggest archiving or indicate elements for possible accountability of the senator. The case will remain under the supervision of the STF.
