Drivers of these vehicles do not risk this fine of up to €600 that many ‘fear’: confirm if you are really off the list

Not all drivers in Portugal are subject to the same rules regarding carrying a triangle and retro-reflective vest, which means that there are vehicles that do not run the risk of fines that can reach 600 euros. The difference is provided for in the Brazilian Traffic Code and applies to specific categories, leaving out some drivers who, in practice, do not need to meet these requirements.

According to article 88 of the , the obligation to carry a triangle and vest applies to most motor vehicles, but not all. Vehicles with two or three wheels, motor cultivators and quadricycles without bodies are excluded, which includes motorcycles, which are therefore not subject to this requirement.

What is mandatory for the rest

For other drivers, the law requires that both equipment be retro-reflective and certified, guaranteeing visibility in lower light situations. These elements must comply with specific European standards, such as EN 471 or EN 1150, with various colors being accepted as long as they are approved.

The warning triangle becomes mandatory whenever the vehicle is immobilized on the carriageway or on the shoulder, or when there is a load lying on the road. Its placement must respect defined criteria: at least 30 meters from the vehicle and visible from a minimum distance of 100 meters.

The retro-reflective vest must be used whenever the driver leaves the vehicle in these situations, namely to signal or intervene on the road. The law states that it must be used when placing the triangle, repairing the vehicle or removing obstacles from the road.

Failure to comply with these rules can result in fines of between R$60 and R$300 for lack of each mandatory piece of equipment. Incorrect use or lack of signage in situations of immobilization can increase the fine to amounts between R$120 and R$600. However, anyone who rides a motorcycle does not risk being the target of these fines.

The legislation also provides for scenarios in which two infraction notices can be drawn up, if there are different infractions at the same time. This happens, for example, when there is a lack of equipment and, at the same time, the vest is not worn in a mandatory context.

In addition to the triangle and the vest, there are documents that must always accompany the driver while driving. These include the Citizen Card, driving license, proof of insurance and vehicle documents.

A lesser-known document

The certificate of conformity is another relevant element, proving that the vehicle complies with European safety and environmental standards. This document is necessary in situations such as imports or technical changes to the car.

The first aid kit is not mandatory for passenger vehicles, but is required in public transport for children. Even so, your presence in the vehicle is recommended, as long as it is accessible and equipped with basic emergency materials.
