An articulation made jointly by the government (PT) and ministers of the (Supreme Federal Court), with the participation of the president of , (-AP), can defeat the report of the (Parliamentary Commission of Inquiry) on Organized Crime that of the (Supreme Federal Court), and .
As shown by Sheetthe government’s account by 6 votes to 5.
In an operation contrary to the report presented by the senator (MDB-SE), three members of the CPI were changed on the eve of the vote this Tuesday afternoon (14). Opposition names and opponents of the STF were replaced by government names, which tend to shield ministers.
The senators (-PR) and Marcos do Val (Avante-ES) left. They were replaced by Teresa Leitão (PT-PE) and Beto Faro (PT-PA).
Senator Soraya Thronicke (PSB-MS) was a substitute and became a member, replacing Senator Jorge Kajuru (PSB-GO) – who was transferred to the substitute position.
CPI seats in the Senate are divided between parliamentary blocs, which are blocs formed by parties, following a criterion of proportion of seats according to the number of senators in each bloc. The person who determines which senators will fill the vacancies of a given bloc is the leader of that bloc.
In the case of the Organized Crime CPI, the bloc formed by MDB, PSDB, Podemos and União Brasil was the one that promoted the exchanges between its members, indicating two names from the PT — a party that does not even make up the bloc. The choice of names, however, is a free decision by the leader, and even senators from other parties can be nominated.
The leader of the bloc was senator Efraim Filho (PB), but he recently left União Brasil for PL and consequently left the leadership. In view of this, the MDB became the largest party in the bloc and the changes were then requested by the party leader and vice-leader of the bloc, Eduardo Braga (AM), who is close to Alcolumbre and a government member.
According to reports made to the report, Alcolumbre worked directly to have the report rejected and had the support of some party leaders.
In the case of the PSB, the exchanges were made by the party itself, which is in government.
In the Lula government, the assessment was that Vieira acted with electoral motivation — the senator should run for re-election in October. Government members also criticized the fact that the rapporteur did not include the former banker, politicians linked to him and common criminals in his report.
Vieira left out business people and common crimes in the report. He stated that it was a technical choice. Apart from Vorcaro, there are, for example, no accusations of crimes against politicians such as , do , and , do ,
Until now, the government supporters have formed a majority in the CPI, whose president is senator Fabiano Contarato (PT-ES). This group approved breaches of confidentiality and summons of witnesses at the CPI that implicated STF ministers in the Master.
Therefore, for members of the opposition in the CPI, the government members will have to choose between maintaining the support they gave to the investigation and Vieira —and, therefore, approving the report— or shielding the STF and .
However, the STF ministers will undergo an impeachment process in the Senate, as Vieira proposes. This depends on a decision by the President of the House, which may or may not determine the opening of a removal process for a crime of responsibility. Alcolumbre has always shown signs that he is against the opening of impeachment.
In the report, Vieira states that Moraes and Toffoli acted “in a manner incompatible” with the honor, dignity and decorum of their duties due to their relationship with the . In Gilmar’s case, he points out that the minister would have suspended breaches of confidentiality by the CPI to protect his colleagues.
The CPI was created and factions operated in the country, especially linked to drug trafficking. However, senators began to use the commission to overcome resistance to the creation of a CPI to investigate Banco Master and its relations with authorities, especially STF ministers.
