An action filed with the Federal Supreme Court against the bill under an emergency regime that ends the bill was drawn to the minister.
The action was requested by federal deputy Ricardo Salles (Novo-SP) with support from Fiesp (Federation of Industries of the State of São Paulo). In it, the parliamentarian argues that the Lula government’s request for urgency is incompatible with the need to carefully examine the matter.
“Even given the rooting of this issue in the national legal system, the Executive Branch formulated the request for urgency without presenting any concrete justification that demonstrated exceptional circumstances capable of compressing the legislative process”, says Salles’ action.
“This institutional participation evidences the recognition, by the Executive Branch itself, that the matter requires qualified treatment — incompatible, therefore, with the abbreviated procedure now imposed”, the action continues.
The fact that the case fell to Mendonça, filled the right with hope.
The project with constitutional urgency was presented by Lula to try to speed up the approval of the matter, since the PT member wants to use the issue as an electoral flag.
Despite this, a constitutional amendment project with the same purpose is further advanced in Congress.
