Moraes authorizes open regime for hacker in the Zambelli case – 05/07/2026 – Brasília Hoje

The minister of the (Supreme Federal Court) authorized this Thursday (7) that the man, convicted by the (National Council of Justice), will serve his sentence in an open regime, with the use of an electronic ankle bracelet.

According to Moraes, documents from the prison unit show “the excellent behavior” of the hacker, who is in Penitentiary 2 of Potim, in São Paulo. “Thus, once the objective and subjective requirements have been met, regime progression is an necessary measure”, wrote the minister in his decision.

The former deputy (PL-SP) was convicted in the same action as Delgatti.

Moraes maintained the cancellation of Delgatti’s passport and determined that the hacker must prove that he is working and will not be able to use social media. Furthermore, you will be prevented from leaving your home from 7pm to 6am, on weekends and holidays.

He must still appear before the Execution Court every week to justify his activities and cannot leave his district without judicial authorization.

In January, the minister addressed the hacker, considering the time already served and his behavior. About three months later, Moraes after he passed Enem in 2025.

According to the (Attorney General’s Office), which spoke out in favor of the progression of the regime, after reductions, Delgatti’s sentence is seven years, 11 months and 19 days. The change is permitted by law because he has already served 20% of this period.

Zambelli and Delgatti were unanimously found guilty by the First Panel of the STF for the crimes of hacking a computer device and misrepresentation.

The penalty set for Zambelli was 10 years in prison under an initial closed regime and a fine worth two thousand minimum wages. Delgatti’s sentence was set at eight years and three months in prison, also under an initial closed regime, and a fine of 480 minimum wages.

They will also have to pay compensation of R$2 million for collective material and moral damages. According to the legislation, both are ineligible from the moment of conviction until the end of a period of eight years after serving their sentence.

Zambelli is imprisoned in Italy and is considered a fugitive by Brazilian justice. President Lula’s (PT) government already.
