A coalition of eight civil society entities, such as República.org and Movimento Pessoas à Frente, released a document this Friday (8) condemning the increase.
The group claims that the thesis established by the (Supreme Federal Court) on penduricalhos in March. At the time, the court prohibited the creation and payment of compensation funds, excluding those that were considered exceptions by the ministers themselves, when making the decision on .
After that, courts of justice and public prosecutors in eight states. A report from Sheet found 14 initiatives spread across Bahia, Ceará, Mato Grosso, Minas Gerais, Pará, Paraná, Rio Grande do Sul and São Paulo.
According to the note, since the STF’s decision, there is a new impulse to create compensation funds, which are outside the reach of the ceiling.
Among the additional benefits created after the STF decision are incentive bonuses for positions that are difficult to fill, retroactive bonuses for length of service and early childhood benefits.
The note cites as an example the possibility of reimbursing gym expenses, sports practices and in vitro fertilization for members of the AGU (Attorney General of the Union), which was suspended the day before it came into force.
The group notes that the AGU gave as a justification for creating this payment a kind of approximation of the amounts paid by the Judiciary. According to the coalition, this is a cascade effect between careers.
The text states that there is support for combating super salaries: a survey by AtlasIntel, in partnership with República.org, released in 2025, showed that 90.5% of Brazilians support, totally or partially, measures to restrict payments above the ceiling.
A Datafolha survey commissioned by the People Front Movement shows that 83% of the population supports a review of benefits and aid.
The entities also criticize the slowness in processing legislative proposals that would reinforce compliance with the ceiling. The Executive, it is claimed, is absent from this debate.
The situation is described as “an administrative and legal disorder that weakens the legitimacy of institutions and deepens structural inequality in the public service”.
