Deputies involved in riot can still appeal to the CCJ about suspension

After the suspension has been approved by the Ethics Councilthe deputies Marcos Pollon (PL-MS), Zé Trovão (PL-SC) e Marcel van Hattem (Novo-RS) will still be able to appeal the decision to the CCJ (Constitution and Justice Commission) and depend on the decision of the plenary to be effectively removed.

To appeal to the CCJ, deputies have a period of five working days after the publication of the opinion approved by the Council in the Official Gazette of the Chamber. The publication has not yet been made. The final decision, however, will be made by the plenary. The votes of 257 deputies are needed to confirm the suspension.

Marcel van Hattem considered the decision “unfair” and has already announced his intention to appeal to the CCJ.

The actions in the Council were presented by the Board of Directors of the House in September last year following a recommendation from the Chamber’s inspector, deputy Diego Coronel (PSD-BA). Originally, the representations asked for the deputies to be removed for 30 days.

The Council rapporteur, deputy Moses Rodrigues (União-CE), however, extended the punishment to two months. The three deputies were the target of lawsuits for having prevented Hugo Motta from resuming his presidential seat in the plenary.

On that occasion, opposition parliamentarians blocked plenary proceedings for more than 30 hours in protest against the house arrest of former president Jair Bolsonaro (PL). The movement occurred during the week of resumption of activities in the Legislature after the July parliamentary recess.

Mayor Hugo Motta (Republicanos-PB) did not take a position on the suspension, but spoke of “respect” for the Ethics Council’s decision.

“The Ethics Council is responsible for making this judgment and we have to respect the decision of the Ethics Council taken yesterday”, said Hugo in an interview with journalists at the Chamber.
