There is a public list on the Finance Portal that many taxpayers have never consulted, but where names of people and companies with tax debts may appear. The information is available online and can be searched by anyone, without the need for authentication.
According to , the list of tax debtors includes taxpayers with tax debts above R$7,500. The registration is the responsibility of the Federal Revenue Service and identifies debtors by CPF, name and debt range.
Who is included in the list of debtors
The list includes taxpayers who did not settle tax debts within the legal deadline, nor did they present a guarantee or obtain an exemption from this obligation.
According to information available on the Finance Portal, the data processed corresponds to the NIF, the name of the holder and the level of the global value of the outstanding debt. The list is organized by type of taxpayer, distinguishing individuals and legal entities. In practice, the exact amount owed is not indicated, but rather the range in which the taxpayer falls.
How to consult the list
The query is made on the Finance Portal, in the debtors list area. Unlike other tax services, this list is public and does not require login. This means that anyone can check whether a particular taxpayer or company appears among the published debtors.
Even so, to confirm their complete tax situation, the taxpayer must access the personal area of the Finance Portal, where they can consult debts in voluntary collection or tax execution.
How to remove your name from the list
There are two main ways to leave the list: pay off the debt or contest the inclusion. The most direct way is to pay the amount owed. If you are unable to pay everything at once, the taxpayer can request an installment payment, as long as it meets the requirements defined by the Federal Revenue Service.
The second possibility is to exercise the right to rectify, eliminate or limit the processing of data, if you believe that the inclusion was inappropriate.
When can you contest
Disputing can make sense in several situations. The taxpayer may request the deletion of the name if the debt does not exist, if it has been declared time-barred, if a guarantee has been provided as part of a grace complaint, judicial challenge or opposition to tax enforcement, or if there is a legally authorized payment in installments.
You can also ask for the tier to be corrected if you consider that you have been placed in the wrong category.
According to the Tax Authority, the list is updated daily to remove debtors who have since regularized their situation, namely through payment or provision of a guarantee.
Even so, the exit depends on confirmation of payment or the suitability of the guarantee by the competent services, which can take, on average, up to around a week. New debtors are admitted monthly, whenever they meet the legal requirements for publication.
There are cases where the value may seem strange
The AT admits that, in some cases, taxpayers may appear at a level with debts worth less than the apparent minimum limit of that level.
This may happen due to partial debt cancellations, guarantees worth less than the amount due or other similar situations. Therefore, anyone who disagrees with the position should request its rectification.
Why is this data public
The Federal Revenue explains that the disclosure is intended to comply with the legal obligation to disclose lists of debtors.
The data originates from AT databases and results from taxpayers fulfilling their reporting obligations. Advertising is maintained until the debt is paid off, respecting applicable legal limits, including limitation periods.
What should you do if you find your name
If the name appears on the list, the first step is to check your tax situation on the Finance Portal. Afterwards, you must confirm the origin of the debt, the amount in progress and whether there is any form of payment, claim or guarantee already presented. If the debt is valid, settlement is the quickest way to get off the list.
If you consider that the inclusion is inappropriate, you must submit a request for correction or deletion to the Tax Authority, gathering documents that prove payment, prescription, guarantee or other legal basis.
In the end, being on the list does not mean there is no solution, but it does require action. Paying, guaranteeing the debt or complaining when there is an error are the ways to remove the name from the public list of debtors to the Tax Authorities.
