Minister Šutaj Eštok faced the court: the Ministry violated the law when transferring police officer Svítok

At the hearing on Thursday (May 14) in the case of the reassignment of police officer Juraj Svítok, the Administrative Court in Bratislava annulled the decision of the Ministry of the Interior (MOI) of the Slovak Republic and returned the matter to the public administration body of the first instance for further proceedings. This was confirmed for TASR by the Administrative Court in Bratislava. “The written version of the judgment will be delivered to the participants of the proceedings within the period established by law and will be published after it becomes final,” added the court.

Peter Kubina, Svítok’s legal representative, informed the court about the verdict already on Thursday. He explained that the court evaluated the illegality of Svítok’s reassignment from the Inspection Service Office in Bratislava to the District Directorate of the Police Force in Bánovce nad Bebravou, in the case decisions made by the director of the police inspection Branislav Zurian and the minister of the interior Matúš Šutaj Eštok (Hlas-SD) when confirming the personnel order in the appeal procedure.

“The illegality of their actions consisted in the fact that, according to the law, the prior consent of the Office for the Protection of Whistleblowers was required for this act, which they did not even ask for.” wrote Kubina on the social network. The Ministry of the Interior said on Thursday that it will decide on the next course of action only after the judgment has been delivered and it has become familiar with its justification.
