Dentist is reported by SC MP after patient loses part of his vision

The Santa Catarina Public Prosecutor’s Office charged a dentist for carrying out surgical procedures on patients without the necessary qualifications, leaving a victim with very serious injuries to the face and partial vision impairment in the left eye, in February this year.

The MPSC complaint was presented this Friday (15). The professional was reported for serious bodily injury.

Blepharoplasty and eyelid corner surgery procedures were performed between February 11th and 27th on an elderly woman. According to the complaint, the victim suffered cosmetic damage and partial impairment of vision in her left eye.

According to the MPSP, the procedures carried out by the professional are considered to be on the face, as both involve the removal of excess skin in the eye region.

Therefore, both procedures are characterized as surgical techniques specific to medicine and must only be carried out by qualified professionals, in accordance with CFO Resolution No. 230/2020.

The dentist reported did not have the necessary specialization nor was she qualified to perform the surgical techniques.

On the same patient, the professional would also have performed a procedure known as a jowl lift, for which she was qualified.

However, the combination of procedures caused aesthetic and functional impairment to the victim, in addition to damage to the eye, such as inflammation of the cornea, blurred and fluctuating vision and excessive tearing, among other symptoms.

Still in the complaint, the MPSC asked the Court for full compensation for the material damage caused and the payment of compensation for moral damages in the minimum value of R$50,000. If convicted, the dentist could receive a sentence of six months to two years in prison for illegal practice of medicine and two to eight years in prison for very serious bodily injury with permanent deformity.
