Agency linked to the Ministry of Justice is responsible for controlling obligations set by the Supreme Court in a 2025 decision
Minister Gilmar Mendes, from , used his profile on Wednesday (May 20, 2026) to support those of the president (PT) on social media. The measures regulate rules on big techs, based on what was established in the STF judgment, and create specific rules on violence against women. Lula also defined an agency linked to the government to oversee these obligations.
In the publication, Gilmar stated the following: “Today, the Federal Government regulated the liability of platforms for criminal content. The decrees give concreteness to the decision of the STF, which recognized that the protection of rights on the internet requires a reinterpretation of article 19 of the Marco Civil da Internet. The regulation, with the attribution of supervision to the ANPD, is a fundamental civilizing advance in the regulation of networks”.
The general rules that increase the possibility of punishing big techs for content transmitted by third parties have already been in effect since this responsibility was established by the Supreme Court in 2025. However, there was no specific body responsible for supervision.
Linked to the Ministry of Justice, the (National Data Protection Agency) now has the responsibility of monitoring compliance with the rules imposed by the Court. With this, the agency becomes a regulatory body for digital networks.
The ANPD also has the role of monitoring the ECA Digital, which defined obligations related to children and adolescents for digital platforms.
The decrees were signed by Lula during the 100 days of Brazil ceremony. The deadline for the rules to come into force should be 60 days.
