Fundac received administrative punishment from the STF after delays in collecting FGTS from employees
The company responsible for operating the Justice TV e Justice Radio, of the Federal Supreme Court, presented an appeal to remain in the new bidding process for the provision of services. According to o Poder360the Court punished Fundac (Foundation for the Development of Arts and Communication) last Monday (May 28, 2026) with its withdrawal from the dispute for the R$ 32.8 million annual tender. The administrative decision alleged delays in collecting the FGTS (Service Time Guarantee Fund), labor failures, delays in sending mandatory documents and losses to employees linked to the contract. Signed by the Secretary of Budget, Finance and Contracts of the STF, Márcio Kazuaki Fujissava, the punishment also imposes a fine of R$85,000 and removes Fundac from the new competition for TV Justiça.
The foundation has been under judicial intervention for just over a year. To the Poder360the current intervenor, Daniela Sigliano, stated that Fundac’s current management has prioritized paying off FGTS deposits from other years and advancing benefits to employees, such as paying for workers’ health plans.
According to Sigliano, Fundac appealed the STF’s administrative decision because it considers it necessary to maintain the provision of services to gradually pay off tax and labor debts. The judicial intervener states that the proposal to continue managing the Justice TV is compatible with administrative rules and demonstrates viability to continue providing services.
The decision to fine Fundac and suspend hiring took place after the Poder360 ask the STF for a position on the situation narrated by the employees.
According to the STF decision, Fundac accumulated “23 occurrences of grade 1”, which refer to administrative or labor issues, and were considered sufficient to characterize “partial non-execution” of the contract. “This contract is a shame. And the company had already been prevented from participating in new tenders in the Chamber”, said the president of the radio broadcasters’ union, Marcos Clemente.
The Court declared that the delays were not just bureaucratic. According to the administrative decision of the STF, the documents collected by the inspection “they simply didn’t exist” at the time they should have been presented because payments and collections had not yet been made.
