Senator Rogério Marinho (PL-RN) presented a demonstration to the President of the Court in defense of the autonomy of the Electoral Court
O senator Rogério Marinho (PL-RN)leader of the opposition in the Senate and general coordinator of Flávio Bolsonaro’s pre-campaign, met this Wednesday (28) with the president of Minister Edson Fachin, to present a demonstration in defense of the autonomy of the Electoral Court and cagainst alleged interference by the Supreme Court in the electoral process.
Marinho was accompanied by lawyer Marcelo Bessa during the meeting. According to Bessa, the measure seeks to ensure balance in the elections. “A supplementary election requires a minimum reasonable period of time, under penalty of making any minimally fair electoral contest unfeasible,” he stated in a note.
After the meeting, Marinho criticized the performance of the Superior Electoral Court (TSE) in the 2022 elections and said that there was interference in the electoral process. “We had an extremely hypertrophied Superior Electoral Court,” he declared.
The senator stated that the objective of the demonstration is to ensure “equity, balance and parity of arms” among candidates and parties during electoral disputes.
“We want each candidate to be able to express their opinions, so that the parties can carry out their activity of seeking voters’ votes and making their program available to society to be judged by it,” he said.
STF decisions
Marinho also cited recent decisions involving the Rio de Janeiro and Roraima. According to him, there was a break in the line of succession in the government of Rio de Janeiro and a change in the rules of non-compatibilization in the supplementary election in Roraima after the start of the electoral process.
When commenting on the case of Roraima, the parliamentarian criticized minister Flávio Dino’s decision and stated that the measure could make candidacies unfeasible and compromise the competitiveness of the dispute.
According to Marinho, the main problem is the weakening of Electoral Justice specialized in decisions taken directly by the STF. He also stated that he had asked Fachin for the issue to be analyzed by the Court’s plenary.
“What we want to avoid is that this becomes a habit. It is a dangerous precedent for democracy and for the free expression of the population through elections”, he stated.
