Minister Alexandre de Moraes, of the Federal Supreme Court (STF), released for trial the criminal action in which former federal deputy Eduardo Bolsonaro (PL-SP) is accused of promoting United States tariffs against Brazilian exports. The trial in the case was scheduled for Tuesday (16).

The case will be judged by the First Panel of the Court, which is also made up of ministers Flávio Dino, Cristiano Zanin, Cármen Lúcia, in addition to Moraes, rapporteur of the case.

In November last year, the STF accepted a complaint from the Attorney General’s Office (PGR) in the investigation that investigated the former parliamentarian’s actions with the United States government to promote tariffs against Brazilian exports and the suspension of visas for federal government ministers and court ministers. He is responsible for the crime of coercion during the process.

Since last year, Eduardo Bolsonaro has been in the United States and lost his parliamentary mandate for missing sessions of the Chamber of Deputies.

Before releasing the case for trial, Alexandre de Moraes ordered the former deputy to be notified by notice, but he was neither found nor appointed a private lawyer.

Given the situation, the minister authorized the defense to be carried out by the Federal Public Defender’s Office (DPU).

In the final arguments presented to the Supreme Court, the body defended the annulment of the process and said that Moraes cannot judge the case as he may have been a victim of visa cancellation and financial sanctions arising from the Magnitsky Law.

“Here the Judge is, at the same time, the main victim of the conduct he is called to judge”, said the DPU.

According to the accusation made by the PGR, Eduardo encouraged the actions of the United States to try to prevent the Supreme Court from convicting former president Jair Bolsonaro in the coup plot process.

“It was proven that the defendant deliberately used serious threats against the authorities responsible for the trial of AP 2,668, some of which were carried out, in order to favor the interests of his father, freeing him from any criminal liability”, argued the prosecutor.
