The minister Alexandre de Moraesfrom the STF (Supreme Federal Court), authorized this Tuesday (9) that the general Paulo Sérgio Nogueira realize o Enem (National High School Examination).
The general’s defense asked the minister for permission for him to register for the exam, which is scheduled to take place on December 16th and 17th for people deprived of their liberty.
Currently, Nogueira is in a closed regime in Planalto Military Commandin Brasilia. The former Minister of Defense of the government of Jair Bolsonaro (PL) it was due to an attempted coup d’état in November 2025.
In this Tuesday’s decision, Moraes mentioned art. 1st of Law 7,210/1984 (Penal Execution Law), which establishes the availability of conditions for the social integration of the convicted person during the execution of the sentence.
The judge also argues that “among the means necessary for the convicted person to be reintegrated into society, the most important is the remission of the sentence through work or study, regulated in articles 126 to 130 of the Penal Execution Law”.
“The governing legislation aims to encourage the prisoner to study, so that the request formulated involves approval”mentions Moraes in the opinion.
Carrying out activities during the period of imprisonment, such as reading, working or studying, . Moraes’ decision in favor of Nogueira comes in the wake of other similar opinions issued since the general’s arrest.
As shown by the CNNat the end of 2025, the magistrate had already authorized Nogueira to work and read in prison after a request from the defense. At the beginning of this year, also at the request of lawyers, the former minister was allowed to study .
