The deputy (Cidadania-SP), rapporteur in the Chamber of the bill that establishes the National Critical Minerals Policy, stated this Tuesday (June 9, 2026) that the text is “dammed” in the Senate because of the friction between the government (PT) and the president of the Casa Alta, (União Brasil-AP), which worsened after the rejection of Jorge Messias’ nomination to the Federal Supreme Court.
“Everyone knows that today there is a discussion. This issue, which is a political issue, which involves the Senate’s relationship with the government, is what is determining [o atraso da análise do PL dos minerais críticos na Casa Alta]”, Jardim told journalists during the International Seminar on Critical and Strategic Minerals at the Brazilian Mining Institute.
According to the deputy, other projects linked to infrastructure, such as the concessions and PPPs framework, are also in the same situation.

The deputy said he hopes that senators will make changes to his report, but projects that the original structure should not be changed. The Senate has not yet defined who will be the rapporteur of the proposal in the House or which committees the text should pass through.
“A political assessment that fits me is that the group that was created will have improvements, but it is unlikely that the Senate will disagree, diverge or establish a new direction”said Jardim.
When commenting on the approval process in the Chamber, he praised the dialogue established with the government, through the Ministry of Mines and Energy, and said that he hopes that Palácio do Planalto does not make changes to the proposal.
“I think this synchrony between the Executive and Legislative branches is something that drives a lot there [no Senado]. It was thus constituted. So, I believe, it will come out of the Senate and the Executive has agreed”these.
GOVERNMENT COUNCIL
Jardim also refuted criticism about the creation of a government Council that will analyze new mineral exploration projects, one of the most controversial points in his report.
The corporate operations of mining companies established by the project had been the target of criticism from the private mining sector, which warned of the possibility of legal uncertainty in the segment. Jardim even changed the project due to pressure from companies.
The mining companies understood that the section would allow the Executive to previously veto mergers, acquisitions, corporate reorganizations and changes of control in companies that have rights to critical and strategic minerals. The deputy responded to questions asked at the time of the vote.
“The Council is not supposed to be bureaucratic. The Council will stick to regulatory studies, and I know that the Ministry itself is preparing proposals in this regard, in accordance with the spirit. It will focus on the same projects, it will have a process of delegating what is the most common issue, of simplification, of using the government’s existing structure. No one will reinvent the wheel, that is, it will really take care of those issues that will be more strategic”he declared.
